Description

This class action seeks compensation for the anti-competitive behaviour of the Respondents, who engaged in price-fixing and manipulation of the market of additives, which are used to promote or create certain properties in concrete.

This class action is at the authorization stage. No hearing date has been set yet.

One of the objectives of this class action is to obtain financial compensation for those affected by the overcharge prices caused by the Respondent. (please note that there is currently no judgment or settlement awarding such compensation).

This proposed class action concerns the following prospective class:

Any person in Canada, whether corporate or individual, who purchased:

any additive or admixture for use in cement, mortar, concrete or shotcrete (“Concrete Admixtures”) from one or more of the Respondents (the “Direct Purchasers”);

Concrete admixtures manufactured by entities other than the Respondents (the “Umbrella Purchasers”);

And/or

a product that included concrete admixtures manufactured by the Respondents (the “Indirect Purchasers”),

between May 11, 2018 and the date on which the present action is authorized by the Superior Court of Quebec (collectively, the “Class”).
