This proposed class action seeks compensation for the price fixing and market manipulation of starter batteries by the Respondents. These batteries are known as starting-lighting-ignition batteries and are used in most motor vehicles worldwide.
This proposed class action is at the authorization stage. No hearing date has been set yet.
One of the objectives of this class action is to obtain financial compensation for the individuals affected by the overcharge prices caused by the Respondents. (please note that there is currently no judgment or settlement awarding such compensation).
This proposed class action concerns the following prospective class:
All legal entities and individuals located in Quebec that have
- purchased a Starter Battery for installation in an affected Vehicle during the Class Period (“Direct Purchasers”); and/or
- purchased or leased a new affected Vehicle containing a starter Battery during the Class Period and/or purchased a starter Battery from an official dealer for installation in an affected Vehicle (“Indirect Purchasers”)
(collectively, the “Class”).
“Class Period” means between January 1, 2004 and the date of the Judgment to be on the Motion for the Authorization of this class action;
“affected Vehicle” means cars, vans, sport utility vehicles, pickup trucks and light trucks (up to 10,000 pounds) manufactured by Bayerishe Motoren Werke AG, Daimler AG, Volkswagen AG, Volvo Group, and/or their subsidiaries or their affiliates, under the following brands: BMW, MINI, Mercedes-Benz, Smart, Volkswagen, Audi and Volvo.
The Respondents, their parent companies, subsidiaries and affiliates are excluded from the Class.
